This seems like an easier option with benefits for all. A charity status may be viewed by the public as a compassionate organisation willing to help others in our field.

If less work is required by the committee annually etc then this must also be seen as a positive move especially with positions being voluntary.

My preference is for a charity. It seems simple that the charity option has more tax benefits, gives us access to grants/funding that we have never had before as well as giving us more credibility being know as a “charity”.

It does appear that there will be an increase in regulatory requirements, however it appears that the ACNC gives support/guidance for this. This increase in regulatory requirement may increase the workload for the executive.

13CHARITYMy understanding is that on reading the finer details that as well as being non-for-profit that ADNA additionally fits the definition of a charity as it has purposes that are charitable and for the public benefit according to the definition of advancing health and education.

If ADNA qualifies as a charity & the benefits seem to be better than not-for- profit , then register as a charity.

What do other nurse associations do ?

If ADNA ceases some time in the future I would suggest monies going to melanoma institute nurse education.

From what I have read, registering as a charity is best for us. Is this correct? If yes, I vote for ‘charity’. If no, I vote for NFP.

> ADNA has been developed over the years to support Dermatology nurses Australia wide and over time have built a strong financials ready to be able to develop accredited education. ADNA’s membership is 99.9% dermatology nurses hence the name of our association. If we change to Charity status our association must be for the betterment of the public, that is anyone. We do not want to be anyone, we want to be Dermatology only,  an accredited specialised field of nursing.

 

>> ADNA are too small and do not need public trustees, who run the board. No need  of a President, Secretary, Treasurer. Our constitution would need to change and clarify the charity rules and regulations.

>> Do we need to focus on such a change now or focus on the need to educate and train  Dermatology Nursing with accredited modules for a specialty field and to be recognised in the Industry and acknowledged by our peers as per our purpose.
>> Other fields may then want to learn from us, which will then open the opportunities  to educate a broader group and highlight OUR platform.

Although I can see and understand  the reasons  the committee  would like to go for charity  status tax wise it just  doesn’t  feel right to claim charitable  status when we don’t actually  ‘give’ . We might benefit the community  from the care of our nurses but those nurses pay for membership  and their education.

Also I think we want our organisation to be viewed as a credible professional  body and calling it a charity lessens that standing.

Just these notes from the NFP Law (Justice Connect) article on the difference between Charity and NFP:

‘The key benefit of being a charity is being eligible to apply for charitable tax concessions’ however ‘getting access to charitable tax concessions can be a more difficult and lengthy process…’

‘Not-for-profit organisations that are not registered charities may still be eligible for tax exemptions’

I think we suit a Not for Profit registration.

we are not a charity….

we don’t raise monies for others less fortunate.

we are an institution that benefits our chosen field of expertise.  so not for profit would be more beneficial than.
